Terms and Conditions

1. General

​This page tells you the terms and conditions on which we supply any of the products ('Products') listed on our website www.tangleandbloom.co.uk or other sites through which we supply Products or services (‘Website’).

 

Please read these Terms carefully before using the Website or making a purchase. Your use of this Website constitutes your acceptance of these Terms and your agreement to abide by them.

 

You should print a copy of these terms and conditions for future reference.

4. Orders and Payment

4.1  The description of the Products on our website, catalogues, brochures or other form of advertisement does not constitute a contractual offer to sell the Products.

 

4.2  When you place an order on the Website, it constitutes an offer to purchase the Products at the listed price.

4.3  By placing an order through the Website, you warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.

 

4.4  We reserve the right to refuse or cancel any order for any reason.

 

4.5  A Contract will be formed for the Products ordered only upon us sending an email to you confirming that the order has been accepted or if earlier, our delivery of the Products to you.

 

4.6  Any quotation is valid for a maximum period of 7 days from its date, unless we expressly withdraw it at an earlier time.

 

4.7  All prices are in GBP (British Pounds) and include VAT.

 

4.8  Payment is accepted through the payment methods provided on the Website.  If you pay by credit/debit card or Paypal, we will take payment when your order is placed.

 

4.9  Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a dispatch confirmation.

5. Delivery

​5.1  We will deliver the Products to the address provided during the order process by the time or within the period agreed, or failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the Contract is entered into. This clause does not apply to custom orders. In such cases, we will endeavour to keep you informed of delivery estimates and any delays.

 

5.2  In the event that the Products are returned to us because of an incorrect delivery address, or you miss your delivery and fail to collect or rearrange delivery from your local depot, additional payment will be required for a second shipping.

 

5.3  Claims of non-delivery must be made within 28-days of despatch.

6. Risk and Title

6.1  The Products will become your responsibility from the completion of delivery or collection. You must, if reasonably practicable, examine the Products before accepting them.

 

6.2  Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

 

6.3  You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

7. Returns and Cancellations

7.1  When purchasing Products online, you have the right to cancel your order within 30 days from the date of delivery. To exercise this right, you must notify us in writing.

 

​7.2  You can use our cancellation form or email us with your order number at info@tangleandbloom.co.uk.

 

7.3  If you wish to return the Products, they must be returned in their original condition and packaging within 14 days of cancelling your order.

 

7.4  You are responsible for the cost of return and the return is at your own risk.

 

7.5  Send your return to Tangle & Bloom, 6 Mower Close, Wokingham RG40 1RZ.

 

7.6  Refunds will be processed within 14 days of receiving the returned Products. We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

 

7.7  Returns of personalised or custom made items, including but not limited to Products in the Bespoke section of the Website, may not be accepted unless they are faulty.

8. Faulty Products

8.1  If the Products arrive faulty or damaged, please contact us within 30 days from the date of delivery. You will be asked to provide your order number and evidence of fault or damage via email, by way of photograph.

 

​8.2  Once we confirm the fault or damage, you may choose a full refund or a replacement item.

 

8.3  We may ask you to return the faulty item or dispose of it responsibly. If a return is needed, we will cover the shipping costs.


9. Descriptions

9.1  Descriptions of goods and services included in the Website are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should be aware that the colours and appearance of images, mounts and frames may vary very slightly from the way they appear on the screen and there may be small discrepancies in size.

 

9.2  In the case of Products made to your special requirements, it is your responsibility to ensure that any information you provide is accurate.

10. Promotions

Where promotions are offered, these do not apply to Products already in the Sale, including promotional events such as Black Friday.


11. Intellectual Property

11.1  All content on the Website, including text, images, graphics, and logos, is protected by intellectual property rights.

 

11.2  You may not use, reproduce, distribute, or modify any content on the Website without our prior written consent.


12. Limitation of Liability

12.1  We are not liable for any indirect, incidental, special or consequential damages arising from the use of the Website or the purchase products.

 

12.2  Our liability is limited to the price paid for the Products.


13. Written Communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our Website, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

14. Notices

14.1  All notices given by you to us must be given to Tangle & Bloom at info@tangleandbloom.co.uk.

 

14.2  We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in 'Written Communications' above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.


15. Events outside of our control

15.1  We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

 

15.2  A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • strikes, lock-outs or other industrial action;

  • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

  • fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

  • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

  • impossibility of the use of public or private telecommunications networks; and

  • the acts, decrees, legislation, regulations or restrictions of any government.

 

15.3  Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.


16. Waiver

16.1  If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

 

16.2  A waiver by us of any default will not constitute a waiver of any subsequent default

 

16.3  No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with 'Notices' above.


17. Entire agreement

We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.


18. Changes to this agreement

18.1  We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.

 

18.2  You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we deliver the Products to you (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within 14 days of receipt by you of the Products)


19. Severability

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.


20. Misuse of our site

We reserve the right to suspend or terminate any members account or open orders which are, or appear to us in our absolute discretion, to be, in breach of any of the provisions of this agreement.
 

21. Governing Law and Jurisdiction 

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
